These Terms & Conditions govern use of the awkconversations.org website, including the Communities Resource Hub, operated by Awkward Conversations Limited (“AC”, “we”, “us”). Our separate Privacy Policy explains how we handle personal data; please read it alongside these terms.

1. Acceptance of Terms

By accessing awkconversations.org, registering for an account, or using the Communities Resource Hub, you agree to these Terms & Conditions. If you do not agree, please do not use the site.

These terms apply alongside our Privacy Policy, which governs how we collect and handle personal data. Where the two overlap on data handling, the Privacy Policy controls; these terms govern everything else about using the site.

2. Who Can Register

You may register if you:

  1. Provide accurate, current information: name, email, organisation, role or title, a persona selection, how you heard about us, and (optionally) marketing consent.
  2. Keep that information up to date if it changes.

You may register as an individual or on behalf of an organisation. If you register on behalf of an organisation, you confirm you’re authorised to do so and that the organisation is bound by these terms for that account’s use of the site.

We may decline or revoke a registration where information provided is false, misleading, or where registration would breach these terms.

3. Account and Membership Terms

Membership sits on a tiered structure. Only Guest Pass is open for signup today; the other tiers are shown on the site but not yet purchasable.

While a tier is not yet open, referring to it on the site is informational only and does not create a right to purchase or a reservation of price or availability. We’ll update these terms and post separate pricing and billing terms before any paid tier goes live.

Each account is for one person’s use. You’re responsible for keeping your login credentials confidential and for activity under your account; tell us promptly if you suspect unauthorised use. We may change tier structure, features, or (for future paid tiers) pricing, with reasonable notice.

4. Acceptable Use

When using the site, including the Resource Hub, you agree not to:

  1. Scrape, systematically copy, or bulk-download content, in any of the site’s languages (EN, TC, SC).
  2. Reproduce, republish, or redistribute Resource Hub content or consultancy materials outside the site without our written permission (see Intellectual Property, below).
  3. Impersonate another person or organisation, or misrepresent your affiliation with one.
  4. Harass, discriminate against, or direct hateful conduct at other users, contributors, or ‘Voices’, which runs directly counter to why the Hub exists.
  5. Upload or transmit anything unlawful, defamatory, or that infringes someone else’s rights.
  6. Interfere with the site’s security, availability, or normal operation (including attempting to bypass access controls on paid tiers once they launch).
  7. Use the site to build a competing product or directory.

We may remove content, restrict features, or take the account actions described under Termination and Suspension for a breach of this section.

5. Intellectual Property

Unless stated otherwise, all content on awkconversations.org, including site text, design, the Communities Resource Hub library, and consultancy materials, belongs to Awkward Conversations Limited or is used under licence. This includes content contributed by Founding ‘Voices’ and partner organisations, which they’ve licensed to us for the Hub under separate contributor agreements.

Registering an account gives you a personal, non-exclusive, non-transferable licence to view and use this content for your own reference. It does not give you the right to reproduce, republish, resell, adapt, or distribute it, in whole or in part, in any language, without our prior written permission. This applies in particular to consultancy frameworks, workshop materials, and Resource Hub content, which are not licensed for reproduction.

“Awkward Conversations,” “AC,” and the Communities Resource Hub name and branding are ours. Nothing in these terms transfers any of our intellectual property to you.

6. Disclaimer

Content on this site, including the Resource Hub, is general information about DEI topics. It’s meant to build awareness and inclusion literacy, not to diagnose or resolve any organisation’s specific situation.

Where content reads as advice, for example something framed as a tip, guide, or recommendation, it’s general DEI information. It’s never medical or legal advice; for either of those, please speak to a qualified professional in that field.

It is not a substitute for a bespoke Awkward Conversations Limited consultancy engagement, and using it doesn’t create a consultancy, advisory, or client relationship between you and us. If you need advice or an intervention tailored to your organisation, engage us (or another qualified adviser) directly.

Content contributed by Founding ‘Voices’ and partner organisations reflects their own views and expertise, not necessarily ours. We don’t guarantee that any content is complete, current, or applicable to your circumstances, and we don’t warrant any particular outcome from using it.

7. Limitation of Liability

The site is provided “as is.” We don’t guarantee it will be uninterrupted, error-free, or available at all times, and we’re not liable for loss caused by outages, bugs, or content inaccuracies.

Much of the Resource Hub, and other parts of the site, is created by partner organisations and contributing ‘Voices’, not by us. We don’t independently verify their content the way we’d stand behind our own, and we’re not liable for its accuracy, completeness, or the consequences of relying on it.

To the extent permitted by Hong Kong law, we exclude liability for indirect, incidental, or consequential loss (such as lost profits, business, or data) arising from your use of the site. Where liability can’t be excluded, it’s limited to the greatest extent the law allows.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited under Hong Kong law, including liability for death or personal injury caused by negligence, or for fraud.

8. Termination and Suspension

You can close your account at any time by contacting us.

We may suspend or terminate an account, or restrict access to the Resource Hub, if you breach these terms (including the Acceptable Use section), provide false registration information, or if we reasonably believe your use puts the site, other users, or contributors at risk. Where practical, we’ll give you notice and a chance to explain first; for serious breaches, we may act immediately.

On termination, your right to access the site ends. Since paid tiers aren’t live yet, this doesn’t currently involve refunds; once paid tiers launch, cancellation and refund terms will be set out separately. Sections that by their nature should survive termination, including Intellectual Property, the Disclaimer, Limitation of Liability, and Governing Law, continue to apply.

9. Changes to These Terms

We may update these terms from time to time, particularly as paid membership tiers launch. We’ll post the updated terms on this page when we do, and for material changes we’ll aim to give registered members reasonable notice, such as a site notice or email.

Continuing to use the site after a change takes effect means you accept the updated terms.

10. Governing Law and Contact

These terms are governed by the laws of the Hong Kong Special Administrative Region, and any dispute is subject to the jurisdiction of its courts.
